Umbrella Trademark - Netherlands

An umbrella trademark is a common trademark for a group of non-prescription medicinal products in Netherlands. An umbrella trademark serves to increase the consumer's recognition of the medicinal products as a group. The composition of the active ingredients, pharmaceutical form and therapeutic indications of these medicinal products may vary.

The umbrella trademark is part of the name of the individual medicinal product. Names are one of the distinguishing features of medicinal products, along with characteristics such as the pharmaceutical form, strength, and authorisation number (RVG number).

The government has established rules in order to prevent confusion with the name of another medicinal product, and to prevent the name being misleading in terms of its use or the active ingredient it contains. Additional conditions are imposed on medicinal products bearing an umbrella trademark in order to guard against the aforementioned risk of confusion.
